Von dem Eyde der den krieg abschnydet

Wie wol Jm rechten manicherley eydt erfunden wirt / so vil doch jn gemeinen leuffen der gericht geübt wirt / So ist zuwissen das dreyerley eyde so den krieg endet / jm rechten erfunden wirt / Nemlich voluntarium judiciale et necessarium.

Das Erst Jurament voluntarium ist / daß das vßding oder vberkomunge
der parthyen so im krieg hangen / vsserthalb des rechtens gestatt
wirdet.

Juramentum judiciale ist / das ein parthy der andern den eydt gestatt
jm rechten vor dem Richter / vnd der richter dasselbe bestetigt.

Juramentum Necessarium ist / das kein parthy der andern gestatt / sonder
der richter ein parthy zu schweren zwingt / vnd dießer eydt Necessarium ist dryfeltig.

selb zuerfollen / sunder die selb bybrengunge von newem zuthuon / Wie wol
keyn anzeigunge vorhyn ergangen sey / als ist juramentum pro re extimanda
/ vnd wirt genant juramentum in litem / als in arbitrarijs actionibus .
